Argument Over Cover Charges At Las Vegas Nightclub Leaves One Dead

law_books_at_law_libraryA shooting occurred just outside Drai’s nightclub located at Bally’s Hotel and Casino, the nightclubs temporary location. Benjamin Frazier, 41 of Las Vegas has been identified of Las Vegas Metropolitan Police Department’s Sheriff Doug Gillespie as the shooter. Apparently, the suspect asked security if he could preview the inside of the club before paying the cover charge. He was allowed, and then he decided to pay, he returned a short time later asking for a refund, which security refused and an argument ensued. The suspect then pulled out a handgun and shot one security officer in the arm. As the second officer arrived he was shot in the stomach, then a witness attempted to stop the suspect but he fired his gun several times which lead to the death of the innocent man.

With all the witnesses and video evidence of the shooting, the only question remains as to what the Clark County District Attorney’s Office will charge Frazier with. The shooting of the two security guards will likely be charged as attempted murder. But, the death of the other man potentially falls into several different categories of murder. If the District Attorney believes the murder was premeditated he could be charged with 1st degree murder, but based on the initial facts presented and the quickness in which the events occurred, proving premeditation may prove difficult. The likely charged will be felony murder or intentional manslaughter.
