Trafficking Controlled Substance

Trafficking Controlled Substance

Trafficking in Controlled Substance in Las Vegas, Nevada is a Felony offense which carries a mandatory prison sentence if convicted. Nevada Revised Statute “NRS” 453.3385 defines Trafficking in Controlled Substance, as “…intentionally sells, manufactures, delivers or brings into this State or knowingly and intentionally in actual or constructive possession” of any controlled substance.  Trafficking is not only the most serious type of drug charge here in Nevada; it is also one of the broadest. Some call it the “catch-all” drug offense because Trafficking in Controlled Substance covers any person, who manufactures the drug, sells the drug or simply possesses a large amount of the controlled substance.

The punishment for a conviction of a Trafficking in Controlled Substance charge here in Las Vegas varies greatly, depending on the amount of drugs in your possession.  For example, if Courtney was caught with 100 grams but less than 400 grams of cocaine in her purse, she would be facing 2-20 years of prison and a fine of up to $50,000.  If she was caught with 400 grams or more of cocaine or any Schedule I Controlled Substance (other than marijuana) she would face life in prison with a possibility of parole after 10 years, or a fixed term of 25 years in prison with a possibility of parole after 10 years.  It must be stressed, merely possessing these amounts of controlled substance is enough to charge someone with Trafficking. A Trafficking Marijuana charge also carries serious penalties but the amounts of the drug and the penalties associated with it varies greatly from other Schedule I Controlled Substances.
