Embezzlement ranges from a Misdemeanor to a Felony offense in Las Vegas, Nevada, depending upon the amount of money stolen or the value of the property taken.  Embezzlement occurs when one steals money or property that they initially were in legal possession of. For example, if Maria was in charge of payroll for “Las Vegas Construction Inc.”, and she decided to create a fictitious employee to write out payroll checks to, and then take those checks and cash them for her own benefit, she would be charged with embezzlement. Here Maria was legally in possession of the company’s payroll funds, but she paid out of those funds to a fictitious employee and cashed the check for her own use. Thus she has embezzled the company’s funds.
When facing an embezzlement charge where the value of the stolen property or funds is less than $1,200, you would be charged with a misdemeanor, and face up to 6 months in jail, a fine of up to $1,000, and any restitution owed to the victim.  Additionally, the District Attorney can add up the value of separate embezzlement offenses within a six month period, and if the total value is in excess of $1.200 they can use those separate offenses to charge one felony count of embezzlement. If the value of the stolen property or funds is at least $1,200 but less than $5,000 you would be charged with a felony, and face 1-4 years in prison, a fine of up to $10,000, and any restitution owed to the victim.  If the value of the stolen property or funds is $5,000 but less than $25,000, or more you would be charged with a felony and face 1-5 years in prison, along with fines, and any restitution owed to the victim. If the amount in question is at least $25,000 but less than $100,000 the potential prison term is 1-10 years. And lastly, any charge with an amount of $100,000 or more the defendant would face 1-20 years in prison.
